applies from: unknown (the text changed beyond its dates, so no date that moved can be read as the application date)

dates added to the text: 2018-05-30, 2025-11-26, 2027-05-10, 2027-05-11, 2029-05-11

Sources disagree — the text comparison and the EU's own amendment metadata found this change; the amending act's instructions do not mention it. All are shown; none is overruled.

The list of legal instruments referenced at the start of the Annex, following the description of the Directive 76/769/EEC export exemption, has been extended with two additional entries: Regulation (EU) 2025/2509 on the safety of toys, repealing Directive 2009/48/EC, and Regulation (EU) 2018/858 on the approval and market surveillance of motor vehicles and their trailers.

The remainder of the visible text, covering the numbered restriction entries themselves, is identical between the two versions as far as the provided excerpts show.

Both texts are cut off before their end, so any further differences beyond the added references cannot be described here.

A new recital-style reference to Regulation (EC) No 1223/2009 on cosmetic products was added to the list of Official Journal references at the start of the Annex.

In entry 3, the text dropped the R65 hazard-labelling references alongside H304 in several sub-points, leaving only H304 as the cited label, and the general reference to Community provisions on classification, packaging and labelling of dangerous substances and mixtures was reworded to refer to Union provisions on classification, labelling and packaging of substances and mixtures.

In entries 28 to 30, a new point (f) was added to the derogation list in paragraph 2, exempting devices covered by Regulation (EU) 2017/745, and the text was truncated before the remainder of the entry could be compared.

The remainder of the visible entries, including the wording of entries 1 through 31 and their conditions, appear unchanged between the two texts, and the provided excerpt is truncated before the point where any further differences might appear.

Entries 28, 29 and 30 were rewritten so that the classification and Appendix-listing language for each hazard category is now expressed in a single condensed sentence, rather than the earlier format that separated the Table 3.1 and Table 3.2 classification references and listed each Appendix on its own line.

The wording for entry 31's derogation on wood treatment was also expanded, adding detail on permissible benzo[a]pyrene and water-extractable phenol concentrations, packaging size requirements, a restriction on sales to consumers, and a required label statement that were not present in the earlier text before it was cut off.

Both the before and after texts are truncated before the full extent of the changes to Appendices 2, 4, 6 and 12 can be seen, so no further difference in those appendices can be described.

A citation to Directive 2010/75/EU on industrial emissions has been added to the list of referenced Official Journal sources at the top of the Annex.

In entry 6 on asbestos fibres, the earlier text allowing Member States to exempt chrysotile diaphragms in existing electrolysis installations until end of service life or availability of substitutes, with a 1 June 2011 reporting obligation to the Commission, has been replaced by a provision under which any such exemption already granted as it stood on 13 July 2016 continues to apply only until 1 July 2025 for continued use of those diaphragms or of chrysotile used solely for their maintenance, conditioned on compliance with a permit issued under Directive 2010/75/EU, together with a new annual reporting duty by downstream users to the Member State by 31 January of each year, which the Member State forwards to the Commission, and a further provision on inclusion of air-monitoring results where a Member State requires such monitoring.

The provision on the Commission requesting the Agency to prepare a dossier on prohibiting diaphragms containing chrysotile, previously present after the reporting paragraph, does not appear in the corresponding part of the revised text, and the text shown is truncated beyond this point so no further differences can be described.

In entry 23, paragraph 2, the restriction on cadmium in paints has been rewritten to explicitly reference paint codes 3208 and 3209 and to state a numerical concentration threshold of 0,01 % by weight, expressed as Cd metal, for the general prohibition, whereas the earlier text simply prohibited use in paints without stating that threshold in the same sentence.

The follow-on sentence about paints with a zinc content exceeding 10 % by weight now also repeats the paint codes 3208 and 3209 alongside the 0,1 % by weight cadmium limit, a specification not present in that sentence before.

The remainder of Annex XVII shown, including the provisions on painted articles, is unchanged between the two texts, and the text provided is truncated before any further differences can be identified.

Entry 18a on mercury has been expanded with new paragraphs 5 through 8, adding a list of mercury-containing measuring devices for industrial and professional use (such as barometers, hygrometers, manometers, sphygmomanometers, strain gauges, tensiometers and thermometers) that are stated not to be placed on the market after 10 April 2014, including such devices placed on the market empty if intended to be filled with mercury.

The AFTER text also adds specific exceptions to this new restriction, covering certain sphygmomanometers used in epidemiological studies ongoing on 10 October 2012 or as reference standards, thermometers used for standardised tests until 10 October 2017, mercury triple point cells, devices over 50 years old on 3 October 2007, and devices displayed in public exhibitions for cultural or historical purposes.

None of this additional text on measuring devices, mercury pycnometers, or softening-point metering devices appears in the BEFORE version of entry 18a, which ends after paragraph 4.

Entry 6, paragraph 1 now covers mixtures containing asbestos fibres added intentionally, in addition to articles containing them, where the earlier text referred only to articles.

In entries 16 and 17, the derogation wording changes from a reference to ILO Convention 13 "on the use of white lead and sulphates of lead in paint" to a reference to the Convention without that phrase, and it now also extends to placing on the market for restoration and maintenance uses and requires a Member State using the derogation to inform the Commission, none of which appeared in the earlier text.

In the entries 28 to 30 conditions, the reference to the concentration specified in Directive 1999/45/EC is now qualified by the added phrase limiting it to cases where no specific concentration limit is set out in Part 3 of Annex VI to Regulation (EC) No 1272/2008, a qualification absent from the earlier text.

The list of Official Journal reference citations at the top of the Annex gains an additional entry, OJ L 326, 29.12.1969, p. 36, which was not present before.

In entry 23, paragraph 1, the wording introducing the list of polymer types is tightened from a general phrase to one that explicitly points to the list that follows, and the list itself is shortened, with high-density polyethylene (HDPE), acrylonitrile butadiene styrene (ABS) and poly(methyl methacrylate) (PMMA) removed from the polymers named.

Entry 23, paragraph 1 also gains a new final subparagraph directing the Commission, by 19 November 2012 and in accordance with Article 69, to ask the European Chemicals Agency to prepare a dossier under Annex XV assessing whether cadmium use in plastic materials other than those listed should be restricted; the remainder of the text beyond this point is cut off in what was shown.

The annex's entries have been rewritten throughout, replacing earlier wording such as 'shall not be used' or 'shall not be sold' with more uniform 'shall not be placed on the market, or used' formulations, and adding explicit provisions stating that articles not complying with a restriction shall not be placed on the market.

Several entries gained new or renumbered sub-points, updated EC/CAS numbers, and additional derogations or transitional dates, for example new entry 18a on mercury measuring devices and expanded provisions on arsenic-treated wood, asbestos diaphragms, and cadmium.

The earlier version's introductory footnotes and directive-reference list differ from the later version's, and numeric concentration or amount limits in several entries are now also expressed in additional units such as mg/kg alongside the percentage figures used before.

Entries 28, 29 and 30 replace their classification references to Annex I of Directive 67/548/EEC with references to Part 3 of Annex VI to Regulation (EC) No 1272/2008, including new category labels such as carcinogen category 1A/1B (Table 3.1) or 1/2 (Table 3.2), mutagen category 1A/1B or 1/2, and reproductive toxicant category 1A/1B or 1/2, and the concentration-limit cross-reference in point 1 is changed accordingly.

The text shown is truncated before its end in both versions, so any further differences beyond what is quoted cannot be described.
