Paragraph 2 now specifies that the Commission examines applications received under Article 96(5), checks them for required information and manifest errors while taking into account the outcome of the preliminary national procedure, focuses that scrutiny on the single document under Article 94(1)(d), and adds a six-month scrutiny period with a written explanation to applicants if that period is exceeded.

A new paragraph 3 sets out an exemption from the deadline and notification obligation where a Member State communicates that an application has been invalidated by a non-final judicial decision or requests suspension of scrutiny due to pending national judicial proceedings, with the exemption lasting until the Member State restores the application or withdraws the suspension request, and the former paragraphs 3 and 4 are renumbered accordingly.

What is now paragraph 4 changes the basis for the Commission's acceptance or rejection of applications from meeting or not meeting the conditions of this Subsection to meeting or not meeting the conditions laid down in Articles 93, 100 and 101, based on the scrutiny under paragraph 2.
