The revised paragraph 5 adds a requirement that when forwarding an application to the Commission the Member State must include a declaration that the application meets the conditions for protection and certify that the single document referred to in Article 94(1)(d) is a faithful summary of the product specification.
It also adds a new requirement that Member States inform the Commission of any admissible oppositions submitted under the national procedure, which was not present in the earlier text.
A new paragraph 6 is added requiring the Member State to inform the Commission without delay of proceedings initiated before a national court or other national body concerning a forwarded application, and of any invalidation of the application at national level by an immediately applicable but not final judicial decision.
