Article 162 Amendments to Regulation (EU) No 1151/2012 Regulation (EU) No 1151/2012 is amended as follows: (1) Article 36 is amended as follows: (a) the heading is replaced by the following: Content of official controls; (b) paragraphs 1 and 2 are deleted; (c) in paragraph 3, the introductory phrase is replaced by the following: 3. Official controls performed in accordance with Regulation (EU) 2017/… 2017/625 of the European Parliament and of the Council Regulation (EU) 2017/… 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products, amending Regulations (EC) No 999/2001, (EC) No 396/2005, (EC) No 1069/2009, (EC) No 1107/2009, (EU) No 1151/2012, (EU) No 652/2014, (EU) 2016/429 and (EU) 2016/2031 of the European Parliament and of the Council, Council Regulations (EC) No 1/2005 and (EC) No 1099/2009 and Council Directives 98/58/EC, 1999/74/EC, 2007/43/EC, 2008/119/EC and 2008/120/EC, and repealing Regulations (EC) No 854/2004 and (EC) No 882/2004 of the European Parliament and of the Council, Council Directives 89/608/EEC, 89/662/EEC, 90/425/EEC, 91/496/EEC, 96/23/EC, 96/93/EC and 97/78/EC and Council Decision 92/438/EEC (Official Controls Regulation) (OJ L …, 95, 7.4.2017, p. …).; 1).; shall cover: (2) Article 37 is amended as follows: (a) in paragraph 1, the first subparagraph is replaced by the following: 1. In respect of protected designations of origin, protected geographical indications and traditional specialities guaranteed that designate products originating within the Union, verification of compliance with the product specification, before placing the product on the market, shall be carried out by: (a) the competent authorities designated in accordance with Article 4 of Regulation (EU) 2017/…; 2017/625; or (b) delegated bodies as defined in Article 3(5) of Regulation (EU) 2017/….; 2017/625.; (b) in paragraph 3, the first subparagraph is deleted; (c) in paragraph 4, the words paragraphs 1 and 2 are replaced by the words: paragraph 2; (3) Article 38 is deleted; (4) Article 39 is replaced by the following: Article 39 Delegated bodies performing controls in third countries The delegated bodies performing controls in the third countries referred to in paragraph 2(b) of Article 37 shall be accredited to the relevant harmonised standard for Conformity assessment- Requirements for bodies certifying products, processes and services. These delegated bodies may be accredited either by a national accreditation body outside the Union, in accordance with Regulation (EC) No 765/2008, or by an accreditation body outside the Union that is a signatory of a multilateral recognition arrangement under the auspices of the International Accreditation Forum..
