Article 12c is an entirely new provision setting out detailed rules on which liabilities count toward the own funds and eligible liabilities of resolution entities, including conditions on debt instruments with embedded derivatives, intragroup issuances, subordination thresholds tied to percentages of total liabilities and risk exposure, and factors the Board must weigh when making related decisions.
