Article 78a is a newly inserted provision setting out when a resolution authority must grant permission for an institution to call, redeem, repay or repurchase eligible liabilities instruments, including conditions on replacement instruments, sufficient margins over requirements, and continuing authorisation, as well as a general prior permission mechanism subject to time limits and criteria.
The provision also directs the EBA to develop draft regulatory technical standards on cooperation procedures, permission and general prior permission procedures, and the meaning of sustainability for income capacity, to be submitted to the Commission by 28 December 2019.
