Point (b) of Article 28(1) now requires that the instruments be fully paid up and refers to the acquisition of ownership of the instruments not being funded directly or indirectly by the institution, rather than simply requiring the instruments to be paid up and their purchase not so funded.
A new subparagraph was added after point (m) of Article 28(1) stating that only the fully paid-up part of a capital instrument is eligible to qualify as a Common Equity Tier 1 instrument for the purposes of point (b).
A new set of subparagraphs was added to Article 28(3) setting out conditions under which the condition in point (h)(v) of paragraph 1 is considered met notwithstanding a subsidiary being subject to a profit and loss transfer agreement with its parent undertaking, including listed conditions (a) to (f) and a notification obligation to the competent authority.
