Paragraph 2 now lists Regulation (EU) No 648/2012 on OTC derivatives, central counterparties and trade repositories, and Regulation (EU) 2023/1114 on markets in crypto-assets, alongside the previously listed acts defining the scope of the Authority's powers.

The clause describing who the acts apply to has been expanded to also cover issuers or offerors of crypto-assets, persons seeking admission to trading, and crypto-asset service providers, in addition to firms providing investment services and collective investment undertakings marketing units or shares.

The list of directives and regulations defining the Authority's scope of action in paragraph 2 is updated, replacing references such as Directive 2003/6/EC, Directive 2003/71/EC and Directive 2004/39/EC with references to Directive 2014/65/EU and Regulation (EU) 2017/1129, and adding a new passage on contributing to the work of the European Banking Authority on anti-money-laundering matters under Directive (EU) 2015/849 and Regulation (EU) No 1093/2010.

Paragraph 3 now refers to financial market participants and legislative acts and adds mention of sustainable business models and environmental, social and governance factors, and a new paragraph 3a states that the Regulation applies without prejudice to other Union acts conferring authorisation or supervision functions and powers on the Authority.

Paragraph 5 adds a new objective on enhancing supervisory convergence across the internal market, changes references to opinions to be given in accordance with Article 16a, expands the description of how the Authority must act to include non-discriminatory, transparent, proportionate, accountable and fair conduct, and adds text on how its actions and measures must respect applicable provisions and take account of proportionality; a new paragraph 6 establishes a Committee advising the Authority on how its actions should take account of sector-specific differences.
