Article 35 Disclosure of information from third countries The competent authority of a Member State ESMA may disclose the information received from competent supervisory authorities of third countries only if it ESMA or a competent authority has obtained the express agreement of the competent supervisory authority that has transmitted the information and, where applicable, the information is disclosed only for the purposes for which that competent supervisory authority gave its agreement, agreement or where such disclosure is necessary for legal proceedings.
